Terms of service
These Terms of Service govern use of OBM Distribution's online store and purchases made directly from OBM Distribution. By visiting the website, placing an order, or purchasing a product directly from OBM Distribution, you agree to these Terms together with the Privacy Policy, Payment & Shipping Policy, Returns & Refunds Policy, and any product-specific warranty, final-sale notice, custom-product term, or other policy applicable to your purchase.
Online Store Platform
OBM Distribution's online store is powered by Shopify, which provides the e-commerce platform used to offer products and services through the website. Your use of the store may therefore involve Shopify services and technology, subject to the disclosures in OBM Distribution's Privacy Policy and Shopify's applicable terms and privacy notices.
Products and Distribution
OBM Distribution distributes a variety of products and serves as the exclusive distributor for certain products and brands within applicable markets or territories. Product descriptions, specifications, images, availability, warranties, and other information may vary by product and manufacturer.
We make reasonable efforts to provide accurate product and pricing information but may correct typographical errors, pricing errors, product-description errors, inventory discrepancies, or other inaccuracies. Product images are illustrative, and reasonable differences in color, finish, texture, or appearance may occur because of display settings, photography, materials, or manufacturing variation.
Price Match Policy
OBM Distribution will make reasonable efforts to meet or beat an authorized competitor's advertised price for an identical eligible product at the time an order is placed.
To qualify:
• The competing product must be identical.
• Proof of the advertised price must be provided.
• The competitor must be an authorized dealer or seller.
• The product must be in stock and available for purchase.
• The competing offer must involve substantially identical conditions of sale.
• The competing product may not be a floor sample, open-box item, refurbished product, used product, demo unit, clearance item, liquidation item, unauthorized-market product, or otherwise materially different from the new product offered by OBM Distribution.
Price matching must be requested and approved before the order is placed. OBM Distribution does not ordinarily make price adjustments after an order has shipped or been delivered. OBM Distribution may verify the competing offer and reserves the right to decline a price match where the stated conditions are not satisfied.
Pricing and Errors
Unless otherwise stated, advertised prices do not necessarily include shipping, handling, applicable taxes, duties, customs charges, or other order-specific charges. Prices and product availability may change without notice before an order is accepted.
If an obvious pricing, inventory, or product-information error affects an order, OBM Distribution may contact the customer to correct the order or cancel the affected transaction. If payment has already been collected for a canceled item, the applicable amount will be refunded.
Payment Options
OBM Distribution may accept Visa, MasterCard, Discover, American Express, PayPal, money orders, cashier's checks, certified checks, personal checks, prepaid company checks, and wire transfers arranged in advance. Payments generally must be made in U.S. currency.
Orders paid by check or other prepaid method may be held until funds have cleared and payment has been verified. Additional terms in the Payment & Shipping Policy apply.
Credit Card Verification
Credit card transactions may be verified with the card issuer, Shopify, PayPal, another payment processor, or a fraud-prevention provider. OBM Distribution may verify the cardholder's billing address, telephone number, or other order information as reasonably necessary to protect customers and OBM Distribution against unauthorized or fraudulent transactions.
Order Acceptance and Availability
Submission of an order does not guarantee acceptance or product availability. OBM Distribution may decline, hold, or cancel an order for legitimate reasons described in the Payment & Shipping Policy, including payment issues, suspected fraud, product unavailability, pricing or inventory errors, shipping restrictions, or other circumstances reasonably preventing fulfillment.
Shipping and Delays
OBM Distribution uses UPS, FedEx, OnTrac, and other common or freight carriers. Shipping charges and timing are governed by the Payment & Shipping Policy.
Most in-stock orders generally ship within approximately one to two business days after receipt and payment verification, but same-day shipment is not guaranteed. Special-order, custom, personalized, and made-to-order products may require additional production time.
If OBM Distribution cannot ship within an applicable promised timeframe, we will provide any delay notice, cancellation option, consent request, or refund required by applicable law.
Cancellation or Modification
If you need to cancel or modify an order, contact OBM Distribution immediately. There is no OBM Distribution cancellation fee for an order that can successfully be canceled before fulfillment or shipment begins.
Cancellation or modification may not be possible once fulfillment, shipment, personalization, printing, cutting, fabrication, or other custom production has begun.
Custom and Made-to-Order Products
Custom, personalized, printed-to-order, cut-to-order, made-to-order, or other customer-specific products, including applicable custom mat products, may be designated FINAL SALE and non-returnable.
Before placing an order, the customer is responsible for reviewing all personalization, artwork, spelling, measurements, dimensions, colors, specifications, and other customer-supplied or customer-approved information. Once production begins, the order may not be cancelable or changeable.
Custom and made-to-order products may be returned or otherwise remedied only where a qualifying manufacturing defect, workmanship defect, shipping damage, incorrect item, material production error, or other condition covered by the Returns & Refunds Policy or applicable law is verified.
Returns and Refunds
Returns, refunds, exchanges, RMA requirements, return condition, restocking fees, final-sale products, custom-product rules, and refund processing are governed by the OBM Distribution Returns & Refunds Policy, which is incorporated into these Terms by reference.
Product Warranties
Products may be covered by a manufacturer's warranty, an OBM Distribution warranty where expressly stated, or another applicable written warranty. Warranty coverage varies by product.
Intellectual Property and Customer-Submitted Content for Custom Products
If a customer submits artwork, logos, names, photographs, text, or other content for a custom product, the customer represents that the customer has the right to use and authorize reproduction of that content for the requested product.
The customer grants OBM Distribution and its production partners a limited right to use, reproduce, adapt, and transmit the submitted content solely as reasonably necessary to produce, fulfill, support, or remake the customer's order.
OBM Distribution may decline custom content that it reasonably believes is unlawful, infringing, fraudulent, technically unsuitable, or otherwise inappropriate for production.
Fraud and Misuse
OBM Distribution may decline, hold, cancel, or investigate transactions reasonably suspected of involving fraud, unauthorized payment methods, false information, abuse of returns or promotional programs, unlawful resale activity, misuse of the website, or other unlawful conduct, subject to applicable law.
Third-Party Services and Links
The website may use or link to third-party services, including Shopify, payment processors, carriers, manufacturers, and other service providers. OBM Distribution is not responsible for third-party websites or services except to the extent responsibility is imposed by applicable law or expressly assumed by OBM Distribution.
Events Beyond Our Reasonable Control
OBM Distribution will not be responsible for delay or failure to perform caused by circumstances beyond its reasonable control, including severe weather, natural disaster, fire, transportation interruption, carrier delay, labor disruption, governmental action, supply shortage, power or communications failure, public emergency, or similar event. This provision does not limit obligations that cannot lawfully be limited.
Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain effective to the fullest extent permitted by law.
Changes to These Terms
OBM Distribution may update these Terms from time to time. Changes will apply prospectively from the date the revised Terms are posted unless otherwise required by law.
